Navajo Nation To Sue EPA Over Power Plant Permit

Law360, New York (January 24, 2008, 12:00 AM EST) -- The Navajo Nation and Desert Rock Energy Company LLC filed a notice of intent last week to sue the Environmental Protection Agency for failing to issue a permit for the proposed Desert Rock coal-fired power plant within the statutory time frame.

The Clean Air Act requires the agency to take final action on Prevention of Significant Deterioration permits within 12 months after a complete permit application is received, the Navajo Nation and power company say.
