Doctor Prevails In Trial Over 8-Month Erection

Law360, New York (June 17, 2013, 7:46 PM EDT) -- A Delaware state court jury on Monday said a doctor who performed a penile implant that allegedly left a patient with an eight-month erection was not guilty of medical negligence.

Plaintiff Daniel Metzgar alleged urologist Thomas Desperito failed to properly assess, plan, treat, operate on, monitor and postoperatively assess Metzgar, according to his complaint. Desperito also allegedly failed to exercise a degree of skill, care and diligence that reasonably competent providers like him would have exercised under similar circumstances.
