Judge Boosts Royalty Rate For Syntrix's Win in Patent Row

Law360, New York (June 19, 2013, 8:20 PM EDT) -- A Washington federal judge on Tuesday added to Syntrix Biosystems Inc.'s $115 million win in a suit alleging competitor Illumina Inc. infringed its patent covering DNA technology, finding the company was entitled to an 8 percent royalty for ongoing infringement.

U.S. District Judge Benjamin H. Settle agreed with Syntrix that it should receive additional compensation for Illumina's continuing infringement since a jury on March 14 awarded Syntrix $96 million in damages and a royalty rate of 6 percent for past infringement of a patent covering synthetic...
