7th Circ. Revives Suit Blaming Paint For Worker's Death

Law360, New York (June 26, 2013, 8:36 PM EDT) -- The Seventh Circuit on Wednesday reinstated a product liability civil suit alleging that an American Motors Corp. worker's fatal disease was caused by a chemical in paint products, ruling that a Wisconsin federal judge shouldn't have excluded expert testimony that he deemed scientifically dubious.

The appellate court found that U.S. District Court Judge Rudolph T. Randa erred by applying a portion of an oncologist's testimony with which he disagreed — that exposure to any level of benzene is harmful — to the entire testimony. The Seventh...
