Impax's ANDA For Generic Painkiller Spurs Suit

Law360, New York (January 28, 2008, 12:00 AM EST) -- Endo Pharmaceuticals Holdings Inc. and Penwest Pharmaceuticals Co. have tied Impax Laboratories Inc. into another patent infringement lawsuit as the company moves closer to marketing a generic version of pain treatment Opana ER.

Chadds Ford, Pa.-based Endo and Danbury, Conn.-based Penwest said Friday they lodged the suit in the U.S. District Court for the District of Delaware in reaction to Impax’s notice last month that the U.S. Food and Drug Administration had accepted its abbreviated new drug application for review.
