Sanction Policy Unfair In ACA Tax-Exempt Rule, AHA Says

Law360, New York (June 28, 2013, 5:01 PM EDT) -- A recently proposed federal rule spurred by Affordable Care Act requirements for charitable hospitals that wish to maintain tax-exempt status must be changed, the American Hospital Association said Thursday, expressing concern that hospitals may be unfairly penalized under the rule.

In a letter sent to the Internal Revenue Service, the AHA said the proposal's sanction policy creates murky waters for hospitals who have failed to follow the rules, saying hospitals still may be unreasonably subject to discipline even after they have corrected their alleged misconduct. The...
