Apple IOS Is A Program, Ancora Tells Fed. Circ. In IP Suit

Law360, New York (July 3, 2013, 3:57 PM EDT) -- Ancora Technologies Corp. on Tuesday asked the Federal Circuit to revive a lawsuit alleging Apple Inc.'s iOS mobile operating system infringes its patent for software anti-piracy technology, saying a trial judge wrongly construed its use of the term “program” to refer only to applications.

U.S. District Judge Yvonne Gonzalez Rogers threw out the suit in April based on a claim construction that was contrary to the ordinary meaning of “program” and the specifications of U.S. Patent No. 6,411,941, which do not define the term to exclude...
