FERC Trial Staff Rips Ruling Over $1.8B Entergy Project

Law360, New York (July 10, 2013, 6:17 PM EDT) -- Trial staff for the Federal Energy Regulatory Commission on Monday denounced an administrative law judge's decision to block Entergy Corp. from passing on certain canceled costs from an abandoned $1.8 billion repowering project, and demanded a full agency review.

Blasting the judge's allegedly “circular reasoning,” trial staff raised 13 exceptions to the decision and contended that the administrative law ruling raises policy and law interpretation issues that merit a full commission review, according to a brief.
