Boat Co. Escapes Liability For Acquired Assets In CO Suit

Law360, Philadelphia (July 9, 2013, 6:14 PM EDT) -- The Pennsylvania Superior Court on Tuesday affirmed that Brunswick Corp. was not liable to a family allegedly exposed to large concentrations of poisonous carbon monoxide gas from a boat manufactured by a subsidiary, concluding that the family had waived its appeal.

The three-judge panel upheld a trial court's ruling that the family's 1925(b) statement, which under Pennsylvania law offers a listing of errors made by the trial court, was loaded down with a wide range of issues and was fatally flawed as a consequence.
