Pa. Justices To Weigh Who Can Appeal Autism Case Denials

Law360, Philadelphia (July 11, 2013, 6:47 PM EDT) -- The Pennsylvania Supreme Court announced Thursday that it would hear a case that will clarify whether families can appeal an insurer's denial of coverage for autism treatment, after the state's Superior Court determined that only insurers could bring court appeals over decisions made by independent evaluators.

The high court will consider whether the state’s General Assembly intended to draft the state’s Autism Insurance Act, or Act 62, in a manner that limits families’ rights but enshrines the rights of insurers to challenge these decisions.
