Insurers Owe $11M For Australian Gas Shortage, 4th Circ. Told

Law360, New York (July 15, 2013, 8:25 PM EDT) -- Millennium Inorganic Chemicals Ltd. asked the Fourth Circuit on Thursday to uphold a lower court's award of $10.85 million in business interruption coverage after a natural gas shortage crippled some of its Australian operations, accusing two insurers of attempting to rewrite their policies in court.

The insurers, Ace American Insurance Co. and National Union Fire Insurance Co. of Pittsburgh, Pa., are appealing a Maryland judge's finding that they owed Millennium contingent business interruption coverage stemming from an explosion and fire at an Apache Corp. natural gas production facility...
