EU Prods Spain To End Restrictions On Enel Merger

Law360, New York (January 31, 2008, 12:00 AM EST) -- The European Commission launched legal proceedings on Thursday against the Spanish government, saying restrictions imposed on the merger of national energy company Endesa SA with rival companies Enel and Acconia were a violation of the European Union's rules.

The commission sent a “letter of formal notice” to Spain, the first step in an infringement procedure. It asked Spain to explain why it had not withdrawn the conditions imposed by the country's energy regulator, despite the EC's requests.
