Diaper Maker Sat Too Long On Patent Claim, Judge Says

Law360, New York (July 17, 2013, 2:22 PM EDT) -- A Kentucky judge on Monday dismissed a patent suit brought against First Quality Baby Products LLC by a rival diaper maker, saying the Swedish rival's seven-year delay in bringing its suit bars the action under laches and equitable estoppel.

U.S. District Court Judge Joseph H. McKinley Jr. said Swedish company SCA Hygiene Products AB knew it had claims against First Quality since October 2003 at the latest, when it sent the company a letter claiming ownership of U.S. Patent No. 6,375,646, covering “absorbent pants-type diapers.”...
