ResMed, Apex Medical Fight Over Terms Of ITC Sleep Aid Deal

Law360, New York (July 17, 2013, 4:47 PM EDT) -- ResMed Corp. on Tuesday told the U.S. International Trade Commission that Apex Medical Corp.’s proposed agreement to end a patent infringement investigation is insufficient, an objection that could hinder negotiations to close a dispute over sleep disorder breathing devices.  

California-based ResMed said in an opposition motion before the ITC that its Taiwanese rival could not meet Commission requirements merely by agreeing not to import products that infringe ResMed’s asserted patents.
