Court Revives Detecon VIP's Retaliation Suit

Law360, New York (January 31, 2008, 12:00 AM EST) -- A former executive of Detecon Inc. who accused the company of filing a retaliatory action after he sued for overtime wages has partially prevailed in a bid to resurrect his case.

The U.S. Court of Appeals for the Fourth Circuit ruled that telecommunications consulting firm Detecon's former sales director, Larry Darveau, had satisfied his burden for alleging the company fired a retaliatory shot when it sued two weeks after being hit with the wage claim.
