Wyeth Victory In Prempro Lawsuit Survives Appeal

Law360, New York (January 31, 2008, 12:00 AM EST) -- A federal appeals court has affirmed a jury's ruling that an Arkansas woman's cancer was not caused by taking Wyeth, Inc.'s hormone replacement treatments, Premarin and Prempro.

A three-judge panel of the U.S. Court of Appeals for the Eighth Circuit said Thursday that the lower court was within its discretion in ruling to allow the drugmaker's expert testimony and disallow expert testimony introduced by plaintiff Helene Rush. The trial court also did not err in the wording of its jury instructions, the appeals court said....
