Lawmakers Revive Bill Aimed At Frivolous Federal Lawsuits

Law360, Houston (July 18, 2013, 3:41 PM EDT) -- Rep. Lamar Smith, R-Texas, has proposed the latest round of legislation aimed at reducing federal litigation by modifying a procedural rule to force judges to levy sanctions against attorneys who file frivolous lawsuits.

Introduced on July 11 as H.R. 2655, the Lawsuit Abuse Reduction Act of 2013 is Smith’s fourth attempt to undo 1993 changes to Rule 11 of the Federal Rules of Civil Procedure that give judges discretion in deciding whether to sanction lawyers who initiate groundless litigation.
