ITC Accepts Apex Consent Order, Ends ResMed Patent Probe

Law360, New York (July 19, 2013, 5:52 PM EDT) -- A judge at the U.S. International Trade Commission on Wednesday ended an investigation into whether Apex Medical Corp. was importing patent-infringing sleep aid devices, rejecting ResMed Corp.'s claim that Apex's promise to stop importing the products was too vague.

California-based ResMed lodged a petition in April against Apex and Medical Depot Inc., claiming they were importing patent-protected sleep disorder breathing devices from Taiwan.
