Court Reinstates $79.5M Verdict Against Philip Morris

Law360, New York (February 1, 2008, 12:00 AM EST) -- The Oregon Supreme Court has reinstated a $79.5 million punitive damages award against cigarette maker Philip Morris USA Inc., even though the U.S. Supreme Court had already erased the verdict on two separate occasions.

In its decision, the Oregon court said Thursday that Philip Morris' proposed instructions to the trial jury were erroneous in several ways unrelated to the issues addressed by the U.S. Supreme Court.
