IP Attys Cheer Plan To Limit Claims In Patent Cases

Law360, New York (July 22, 2013, 7:18 PM EDT) -- A model order unveiled Monday by the Federal Circuit Advisory Council that calls for limits on the number of patent claims and prior art references that can be asserted in litigation will be an important tool to cut down the cost and complexity of patent cases, attorneys say.

The council, made up of several prominent judges and attorneys, said the sheer number of claims asserted in patent cases is often "problematically excessive" and drafted a proposed order judges can use to restrict them.
