Reversing Course, EPA Nixes Idaho Water Plan

Law360, New York (July 25, 2013, 4:21 PM EDT) -- The U.S. Environmental Protection Agency on Tuesday rejected Idaho's anti-degradation plan for its rivers, streams and lakes, delivering a victory to environmentalists who had claimed the plan imperiled the health of the state's waterways.

The decision, announced in a letter to the Idaho Department of Environmental Quality, rolls back a proposal that would have exempted from environmental review discharges that decreased a waterway's assimilative capacity — its ability to absorb discharges without harm to the life of the waterway — by less than 10 percent....
