Reversing CIT, Fed. Circ. Says Weather Devices Aren't 'Clocks'

Law360, New York (July 25, 2013, 2:56 PM EDT) -- The Federal Circuit ruled Thursday that both customs officials and a lower court had imposed improper tariff-rate classifications on La Crosse Technology Ltd. for devices it imported that measure atmospheric conditions.

The wireless “weather stations” at issue measure and display temperature and humidity and calculate a forecast, but they also show the time and date. U.S. Customs and Border Protection had lumped all of them under a heading for “other clocks.”
