Doctor Loses Bid To Block Bausch & Lomb's Slogan Use

Law360, New York (July 25, 2013, 3:41 PM EDT) -- A Florida federal judge on Thursday found that an ophthalmologist's trademark claims against Bausch & Lomb Inc. over its use of the slogan “See better. Live better.” were not likely to succeed and recommended that the doctor's motion for a preliminary injunction be denied.

U.S. Magistrate Judge Elizabeth Jenkins found that the trademark, which is owned by plaintiff Dr. Stuart Kaufman, is weak and that B&L's use of it is unlikely to cause confusion in the marketplace. She also ruled that Kaufman failed to produce any...
