Zoning Review Still On Hold In Pa. Fracking Battle

Law360, Philadelphia (July 26, 2013, 4:09 PM EDT) -- The Pennsylvania Supreme Court on Thursday ruled that the state’s Public Utility Commission could not evaluate the legitimacy of local zoning ordinances while the high court deliberates on a controversial law that would prevent municipalities from banning natural gas drilling.

The PUC had sought to overturn a Commonwealth Court decision preventing it from implementing provisions in Act 13 that give the commission a role in reviewing and approving the zoning ordinances.
