Verdict On CA's "Unfair" Contract Tossed On Appeal

Law360, New York (February 4, 2008, 12:00 AM EST) -- A jury that sided with a former sales executive for Computer Associates International Inc. in a dispute over unpaid commission had no right to pass judgment on the legality of the company's employment contract, an appeals court has ruled.

In overturning the judgment of the Boston district court, which upheld the jury's verdict, the U.S. Court of Appeals for the First Circuit ruled Friday that Massachusetts law did not allow for a seemingly "unfair" contract to be deemed illegal in consequence.
