4th Circ. Won't Rehear NC Dental Board's FTC Challenge

Law360, New York (July 30, 2013, 5:53 PM EDT) -- The Fourth Circuit refused Tuesday to reconsider its ruling that North Carolina's dental board didn't qualify for immunity from a Federal Trade Commission decision that the board's efforts to block nondentists from offering teeth-whitening services was anti-competitive.

The circuit declined a request from the North Carolina State Board of Dental Examiners to have the entire appeals court rehear the case despite the board's claims that the panel decision refusing antitrust immunity conflicted with U.S. Supreme Court precedent.
