Fed. Circ. Rejects Civil Penalties On Clothing Importer

Law360, New York (July 30, 2013, 5:33 PM EDT) -- The Federal Circuit on Tuesday rejected civil penalties assessed to the president of importer Trek Leather Inc., who was sued by the government for allegedly submitting false import documents, ruling a lower court incorrectly held the executive personally liable for missteps taken in his role as a corporate officer.

In a split decision, the appellate court overturned a fine assessed to Trek's Harish Shadadpuri by U.S. Court of International Trade Judge Nicholas Tsoucalas. The majority said Shadadpuri could not be held individually liable for gross negligence...
