German Court Blocks Illegal Laxative Sales

Law360, New York (February 5, 2008, 12:00 AM EST) -- A German court has barred two pharmaceutical companies, including a Novartis AG subsidiary, from distributing their laxative products containing macrogol, the active ingredient in a constipation treatment manufactured by Norgine Europe BV.

The Hamburg District Court ruled that Novartis unit Hexal AG and Cassella Med GbmH & Co. KG, a subsidiary of German health care conglomerate Klosterfrau Vertriebs GmbH, were illegally distributing their laxative products as medical devices, although they had not received proper approval to market them as medicinal products, Norgine said Monday.
