Pa. Mine Operators Must Report Accidents To DEP: Judge

Law360, New York (August 2, 2013, 3:40 PM EDT) -- A Pennsylvania Environmental Hearing Board judge ruled Wednesday that coal mine operators must err on the side of caution when complying with a state coal mine safety law requiring them to promptly report serious accidents to the state Department of Environmental Protection.

The EHB took up an appeal by Cumberland Coal Resources LP challenging the DEP compliance order that it was slapped with following a May 2011 incident at its Cumberland Mine where a construction manager suffered an electric shock while examining a piece of equipment....
