Fla. Legislators Fight Depositions In Redistricting Challenge

Law360, Miami (August 2, 2013, 3:29 PM EDT) -- The Florida Legislature on Thursday called a request by groups challenging a congressional reapportionment plan to depose lawmakers and legislative staff unprecedented and a violation of legislative privilege.

In a brief filed with the Florida Supreme Court, both houses of the Florida Legislature said that the legislative privilege protecting lawmakers from being deposed is “well-settled law throughout the United States,” where no state legislators have ever been forced to testify about their intent in drafting or voting on legislation.
