W.R. Berkley Unit Denies Duty To Cover TCPA Fax Blast Deal

Law360, New York (August 5, 2013, 3:42 PM EDT) -- A W.R. Berkley Corp. subsidiary asked a Washington federal court on Friday to release it from footing a settlement in a Telephone Consumer Protection Act class action, arguing that its policyholder's unsolicited fax blasting did not amount to a covered personal and advertising injury.

Nautilus Insurance Co. filed a request for summary judgment in a legal fight with GF Protection Inc., which manufactures fall protection equipment for construction workers, over coverage for the underlying class action.
