Ind. Appeals Court Cuts Technicolor's Pollution Coverage

Law360, New York (August 5, 2013, 6:21 PM EDT) -- While applying California law, the Court of Appeals of Indiana reluctantly ruled on Friday that Technicolor USA Inc.'s excess insurance policies did not cover the cost of responding to cleanup orders issued by environmental regulators.

In the published opinion, a majority of Indiana appeals court judges agreed that Employers Surplus Lines Insurance Co.'s policies covered only money damages ordered by a court and not expenses that stemmed from the California Environmental Protection Agency's pollution remediation orders.
