ITC Claims Authority To Fast-Track Patent Cases

Law360, New York (August 7, 2013, 10:12 PM EDT) -- The U.S. International Trade Commission, after an expedited examination process, on Wednesday tossed a suit accusing Hasbro Inc. and several other companies of using packaging that infringed a U.S. company's patents, backing a judge's determination that no domestic industry harm from the imports had been proven.

Yet the commission rejected the judge's finding that the unique ground rules the ITC imposed on the examination of Texas-based Lamina Packaging Innovations LLC’s infringement complaint, which were designed to speed up the process, violated the Administrative Procedure Act....
