Circuit Panel Slams Coke, Plaintiffs Over Bias Suit

Law360, New York (February 6, 2008, 12:00 AM EST) -- An appeals court has affirmed most of a summary judgment in favor of Coca-Cola Bottling Co. in a race discrimination case brought by a group of black employees, while admonishing both the plaintiffs and defendants for engaging in a “shotgun pleading” war.

In a strongly worded ruling handed down Wednesday in the U.S. Court of Appeals for the 11th Circuit, a three-judge panel called the plaintiffs’ complaint “a model shotgun pleading” designed to extort a settlement.
