Coal Plant Modification Violated CAA, Sierra Club Says

Law360, New York (August 12, 2013, 5:45 PM EDT) -- The Sierra Club on Monday sued Oklahoma Gas and Electric Co. in Oklahoma federal court, accusing the utility of unlawfully modifying a unit at one of its coal-fired power plants without a permit, in violation of the Clean Air Act.

According to the environmental group, OG&E in 2008 modified Unit 6 of its Muskogee Generating Station, located in Fort Gibson, Okla., without a permit, which has allowed the 572-megawatt boiler to unlawfully put out more of the pollutants sulfur dioxide, nitrogen oxide, carbon dioxide and carbon...
