Ex-Ind. Utility Chief Dodges Misconduct Charges

Law360, New York (August 13, 2013, 5:51 PM EDT) -- The former chairman of the Indiana Utility Regulatory Commission on Monday dodged criminal charges stemming from his allegedly cozy relationship with Duke Energy Corp. executives from the industry the commission is tasked with regulating.

Marion County Superior Court Judge William Nelson dismissed all four felony counts of official misconduct against David Lott Hardy, pointing to a quirk in state law that prevents criminal charges from being brought for allegations arising from noncriminal acts, according to the order.
