Acne Drug Licensing Suit Allowed To Stay In Court

Law360, Los Angeles (August 13, 2013, 4:26 PM EDT) -- A Delaware court on Monday refused to send to arbitration Anacor Pharmaceuticals Inc.'s suit accusing Medicis Pharmaceutical Corp. of violating a licensing agreement over the development of drugs to treat acne, holding that the contract doesn't say arbitration is mandatory.

Vice Chancellor Donald Parsons of the Delaware Chancery Court denied Anacor's motion to dismiss the suit, finding the agreement didn't expressly say that all potential disputes between the companies had to be adjudicated only through arbitration.
