6th Circ. Says Rejection Of Ch. 11 Plan Isn't Final Order

Law360, New York (August 14, 2013, 1:05 PM EDT) -- In a growing circuit split, the Sixth Circuit on Tuesday ruled that circuit courts do not have jurisdiction to review a district court’s rejection of a reorganization plan because it is not a final judgment.

The precedent-setting opinion sides with four circuits but opposes three others in its interpretation of “final judgments, orders and decrees,” the language Congress used to define the types of lower court actions that are reviewable.
