Judge Won't Ban Kohler Generators Despite Patent Suit Loss

Law360, New York (August 14, 2013, 7:21 PM EDT) -- A Massachusetts federal judge refused Monday to bar Kohler Co. from making marine power generators that a jury found infringed WBIP LLC's patents, but also declined to overturn the jury's $9.6 million verdict against the company.

U.S. District Judge Nathaniel M. Gorton denied WBIP's bid for a permanent injunction banning Kohler from continuing to make and sell the generators that a jury concluded in May include patent-infringing exhaust systems designed to reduce emissions, saying an injunction would be contrary to the public interest.
