Boston Police Drug Test Discriminates, 1st Circ. Told

Law360, New York (August 19, 2013, 3:05 PM EDT) -- A group of black police officers urged the First Circuit on Wednesday to revive their employment suit accusing the Boston Police Department of using discriminatory drug-screening tests of hair samples, saying the test is a “flawed and imprecise weapon.”

The officers claim in a reply brief that U.S. District Judge George O’Toole erred in dismissing the officers’ suit when less discriminatory alternative tests, including urine tests, were available. The officers also allege that the drug test is not job-related, despite the judge's ruling otherwise.
