DOL Coerced Berry Farms Into Wage Settlements, Suit Says

Law360, New York (August 16, 2013, 7:50 PM EDT) -- A pair of Oregon berry farms slapped the U.S. Department of Labor with a lawsuit Thursday, accusing the agency of forcing them into agreeing to admit wage-and-hour violations and pay fines by holding up shipments of perishable blueberries.

Pan-American Berry Growers LLC and B&G Ditchen LLC lodged the lawsuit in Oregon federal court claiming that the DOL misused its so-called hot goods authority under federal labor law to stall shipments of blueberries in August 2012, giving them no choice but to sign onto consent judgments admitting...
