Fla. Residents Say Red-Light Camera Penalties Go Too Far

Law360, Miami (November 7, 2013, 7:14 PM EST) -- Two Florida residents on Thursday asked the state's highest court to invalidate local red-light camera ordinances in Aventura and Orlando, arguing that they are preempted by the Florida Uniform Traffic Control Act.

In oral arguments before the Florida Supreme Court, attorneys for Michael Udowychenko and Richard Masone said the harsh penalties attached to violations detected by the red-light cameras, coupled with the removal of the reasonable doubt standard in the proceedings, make the municipal ordinances conflict with state law.
