Apple's IPhone Design Patent To Be Re-Examined By USPTO

Law360, New York (August 21, 2013, 2:12 PM EDT) -- The U.S. Patent and Trademark Office said Monday that it will re-examine an Apple Inc. design patent covering the appearance of the iPhone that a jury found last year had been infringed by Samsung Electronics Co. Ltd.'s smartphones.

The patent office granted a re-examination request filed by an anonymous party who argued that Apple's design patent, which covers the rounded rectangular shape of the iPhone and other features, may be obvious in view of three Japanese patents that were not considered when Apple's patent was issued....
