EPA Must Revisit Sewage Incinerator Rule, DC Circ. Says

Law360, Chicago (August 23, 2013, 8:53 PM EDT) -- The D.C. Circuit on Tuesday ordered the U.S. Environmental Protection Agency to reconsider its emission standards for sewage sludge incinerators in response to appeals from The Sierra Club and a coalition of municipal agencies that operate the incinerators. 

In an 88-page opinion penned by Judge David B. Sentelle, the appeals panel found that the EPA needs to further explain the methodology behind the emission limits to ensure that they comport with the Clean Air Act, but chose not to vacate the current standards.
