Law360, New York (September 10, 2013, 12:03 PM EDT) -- As the Chinese patent system matures, local Chinese entities have pitted their intellectual property rights against each other in tens of thousands of IP cases annually. Meanwhile, foreign entities make up only small percentage of litigations. Those cases involving foreign companies, and whose outcomes become widely known, often have the foreign company on the short end of the stick. This only adds to skepticism about IP enforcement in China. Perhaps due to such outcomes, foreign companies are turning more toward cooperation rather than confrontation, to build a foundation for success in China. Even if a foreign company plans to forego formal enforcement, IP rights still plays an important role in cooperative dealings....
