EPA Agrees To Take Action On Ariz. Soot Plan In CAA Suit

Law360, New York (August 28, 2013, 3:09 PM EDT) -- The U.S. Environmental Protection Agency will move ahead with its overdue review of particulate matter emissions in Arizona and issue a proposal by mid-January as part of a Clean Air Act citizen suit settlement, the agency said in a Federal Register notice on Wednesday.

The consent decree resolves claims from Phoenix-area residents Sandra L. Bahr and David Matusow, who accused the EPA of shirking its regulatory duties by refusing to enact a federal implementation plan after finding Arizona's state proposal fell short of federal requirements. Now...
