Conservation Easement Bars Pa. Shale Fracking, Judge Says

Law360, Philadelphia (August 28, 2013, 4:17 PM EDT) -- A Pennsylvania federal judge ruled Tuesday that a conservation easement prohibited hydraulic fracturing on a northeastern Pennsylvania tract, dismissing a property owner's lawsuit against an environmental group it bought land with in order to preserve it.

U.S. District Judge James Munley concluded that the conservation agreement negotiated between conservation group Norcross Wildlife Foundation Inc. and Stockport Mountain Corp. LLC  for 900 acres of land in Wayne County, Pa., clearly prohibited fracking by proscribing all commercial and industrial uses of the property.
