'Track 1' Stats: High Allowance Rate, Speedy Prosecution

Law360, New York (September 6, 2013, 11:45 AM EDT) -- The American Invents Act set forth a new opportunity for applicants to respond to the sizable U.S. Patent and Trademark Office examination delays. As of Sept. 26, 2011, applicants could file a request for prioritized examination. Acceptance into the “Track 1” program causes the application to be accorded special status during prosecution. The program’s goal was to provide (on average) a final disposition of the application within 12 months from the date that the request was granted.[1]
