Ecuadoreans Take DynCorp Chemical Suit To DC Circ.

Law360, New York (August 30, 2013, 2:58 PM EDT) -- A group of 2,000 Ecuadoreans accusing government contractor DynCorp International Inc. of spraying harmful herbicides at the Columbia-Ecuador border asked the D.C. Circuit on Thursday to overturn a dismissal of their suit, saying only claims brought by test plaintiffs should be tossed.

A district court determined that the plaintiffs, who brought negligence and tort claims for acute and chronic injuries related to herbicide exposure, failed to establish the reliability of a key expert witness, according to an order entered in February.
