Lundbeck Fights $125M Pay-For-Delay Fine In EU

Law360, Los Angeles (September 3, 2013, 3:41 PM EDT) -- Danish pharmaceutical company H. Lundbeck A/S has appealed a $125.6 million European Commission fine over allegations that it violated antitrust rules by paying generics makers to keep versions of its antidepressant citalopram off the market, saying the decision was rife with legal and factual errors.

Lundbeck filed the appeal Monday in the European Union's General Court, saying the commission hadn't properly allowed the company to challenge the antitrust allegations and had erred by issuing a fine despite the novel legal issues involved in the case.
